BCA (BBCA) dan BEI Digugat ke PN Jakpus

EmitenNews.com – Bank Central Asia (BBCA) dan Bursa Efek Indonesia (BEI) digugat ke Pengadilan Negeri (PN), Jakarta Pusat (Jakpus). Gugatan melawan hukum itu, terdaftar dengan nomor 116/Pdt.G/2023/PN Jkt.Pst pada Selasa, 21 Februari 2023. Penggugat atas nama Eko Darmayanto. 

Berdasar Sistem Informasi Penelusuran Perkara (SIPP) PN Jakpus, dalam gugatan itu, Eko memasukkan Otoritas Jasa (OJK) sebagai turut tergugat I, dan Lembaga Alternatif Penyelesaian Sengketa Sektor Jasa Keuangan (LAPS SJK) sebagai turut tergugat II. 

Dalam petitumnya, Eko dengan kuasa hukum Ervan Susilo Adi Mamonto mendesak PN Jakpus mengabulkan gugatan penggugat untuk seluruhnya, menyatakan para tergugat telah melakukan perbuatan melawan hukum (onrechtmatige daad), memerintahkan kepada turut tergugat I untuk memberikan sanksi kepada tergugat I, dan tergugat II sesuai dengan ketentuan peraturan perundang-undangan berlaku.

Selanjutnya, meminta hakim menghukum turut tergugat I, dan turut tergugat II untuk patuh terhadap putusan perkara a quo, menyatakan putusan ini dapat dilaksanakan terlebih dahulu (uitvoerbaar bij voorraad) meskipun ada bantahan (verset), banding atau kasasi, menyatakan membebaskan penggugat dari kemungkinan gugatan balik dari para tergugat, dan menghukum para tergugat untuk membayar biaya perkara yang timbul dalam perkara a quo.
